Question 1

What is an OTS (One-Time Settlement), and when should I consider it?

Accepted Answer

An OTS is a negotiated settlement with your lender to close an outstanding loan for less than the full amount owed, typically once an account is classified as an NPA or heading toward one. It's worth considering when ongoing repayment is no longer realistic and the business needs a clean resolution rather than prolonged recovery proceedings.

Question 2

My account has received a SARFAESI notice. What happens next?

Accepted Answer

A SARFAESI notice gives the lender the right to take possession of secured assets if dues aren't cleared within the stipulated period. It doesn't mean the situation is unrecoverable — structured options, including negotiated settlement, remain available before matters escalate further.

Question 3

Can my business recover after being classified as an NPA?

Accepted Answer

Often, yes. NPA classification reflects the loan account's status, not necessarily the underlying business's viability. The first step is an honest viability assessment — recovery, restructuring, and settlement are all possible paths depending on what it shows.

Question 4

What's the difference between negotiating directly with the bank and going through an advisor?

Accepted Answer

Banks and ARCs negotiate stressed accounts regularly and have internal benchmarks for what they'll accept, which most promoters don't. An advisor brings structured negotiation experience and a formal settlement proposal built to be taken seriously.

Question 5

Do you only handle SARFAESI cases, or also DRT and NCLT matters?

Accepted Answer

We advise across SARFAESI, DRT and NCLT matters where relevant. Our role is strategic and negotiation-focused rather than legal representation; where formal proceedings require an advocate, we coordinate closely with your legal counsel.
